1. Eligibility

By using this Website, you confirm that you are at least 18 years of age or are using the Website with the permission of a parent or legal guardian and are legally capable of entering into binding agreements.

No content may be copied, reproduced, distributed, modified or used commercially without prior written permission.

4. Website Content

We make every reasonable effort to ensure information published on this Website is accurate.

However, prices, promotions, product availability and service offerings may change without notice.

Errors or omissions do not create contractual obligations.

5. Booking Through the Website

Submitting an inquiry or application does not guarantee acceptance or create a booking.

A portrait session is considered confirmed only after all required booking steps have been completed, including any required agreements and booking fees.

6. Promotional Offers

From time to time Barbara Anne Photography may offer promotions, contests or special portrait experiences.

Each promotion may include its own additional Terms & Conditions which shall take precedence over these general Website Terms where applicable.

7. Intellectual Property Licence

Visitors may access Website content for personal, non-commercial use only.

No licence or ownership rights are transferred through use of this Website.

Barbara Anne Photography is not responsible for the content, privacy practices or accuracy of information contained on external websites.

Before commencing legal proceedings, both parties agree to make reasonable efforts to resolve disputes through informal discussions and, where appropriate, mediation.

Nothing in this section prevents either party from pursuing claims through Small Claims Court or seeking relief relating to intellectual property rights.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

17. Changes to These Terms

Barbara Anne Photography reserves the right to modify these Terms & Conditions at any time.

The most current version will always be posted on this Website with the updated Effective Date.

Continued use of the Website constitutes acceptance of any revisions.

By applying for, accepting an invitation to, booking, or participating in The Woman Within portrait campaign, you acknowledge that you have read, understood, and agree to the following Terms & Conditions.

1. About The Woman Within

The Woman Within is a portrait campaign created by Barbara Anne Photography to celebrate women through portraiture, personal storytelling, and a culminating art exhibition.

The campaign is designed to honour the many ways a woman may choose to be seen — through strength, sensuality, personality, creativity, vulnerability, connection, and legacy.

Participation is by application and invitation. Submission of an application does not guarantee acceptance into the campaign.

Barbara Anne Photography reserves the right to determine which applicants are invited to participate.

2. Participation & Eligibility

Participants must be at least 19 years of age at the time of their portrait session.

Applications must be submitted by the person who will be photographed. Invitations and portrait sessions are personal to the participant and may not be transferred, sold, gifted, or exchanged.

The Woman Within is an individual portrait experience and does not include couples or additional participants unless specifically agreed to in writing by Barbara Anne Photography.

3. Campaign Participation Retainer

A $495 booking retainer is required to confirm participation and reserve the participant's portrait session.

The booking retainer is non-refundable and is applied toward the participant's Woman Within experience.

A session date is not considered confirmed until the required retainer has been received and all required booking documentation has been completed.

4. The Portrait Experience

The Woman Within portrait experience includes:

• A pre-session consultation and wardrobe planning
• Access to Barbara Anne Photography's client wardrobe, where appropriate
• Professional hair and makeup
• A fully guided portrait session
• Up to three wardrobe looks
• Up to three portrait sets
• Professional posing and expression guidance
• A same-day image reveal and ordering appointment
• Inclusion in The Woman Within art exhibition
• The participant's exhibition artwork as a gift following the exhibition
• Inclusion in The Woman Within commemorative magazine
• A digital copy of the commemorative magazine

Specific sets, styling, poses, lighting, wardrobe choices, and creative direction will be determined collaboratively, with final artistic discretion remaining with Barbara Anne Photography.

5. Artwork & Additional Purchases

The $495 participation retainer does not include a collection of portraits or additional finished artwork unless specifically stated in the participant's booking offer.

Participants will view their portraits during their image reveal and ordering appointment and will have the opportunity to purchase portraits, collections, albums, wall art, or other available products.

There is no obligation to purchase additional artwork.

Any artwork purchased is subject to Barbara Anne Photography's current artwork pricing and purchasing terms at the time of the ordering appointment.

Where digital images accompany purchased artwork, the printable resolution of the digital file may correspond to the size of the physical artwork purchased. For example, artwork purchased at 7×10 inches may include a matching digital file suitable for printing up to approximately 10 inches.

Digital files, when included, are for the participant's personal use only unless otherwise agreed in writing.

6. The Exhibition Portrait

Every participant will be represented by a portrait selected for The Woman Within exhibition.

The exhibition portrait will be selected by Barbara Anne Photography as part of the artistic curation of the complete portrait series.

The participant may not necessarily know which portrait has been selected prior to the exhibition.

Following the exhibition, the physical exhibition artwork featuring the participant will be gifted to that participant.

The exhibition artwork has no cash value and may not be exchanged for another product, image, credit, or refund.

7. The Woman Within Magazine

Participants will be included in a commemorative Woman Within magazine or publication created in connection with the campaign and exhibition.

Each participant will receive access to a digital version of the publication. Printed copies may be made available for purchase separately.

Barbara Anne Photography retains editorial and creative control over the design, layout, image selection, sequencing, and presentation of the publication.

8. Image Selection & Artistic Discretion

Participants acknowledge that photography is a creative and subjective art form.

Barbara Anne Photography retains artistic discretion regarding posing, lighting, styling, image capture, editing, retouching, cropping, colour treatment, black-and-white conversion, exhibition selection, and final presentation.

Not every image photographed during the session will be presented to the participant. Barbara Anne Photography will determine which images meet the studio's artistic and technical standards.

RAW, unedited, proof, rejected, or otherwise unfinished files are not provided.

9. Image Use & Privacy

Participation in The Woman Within does not automatically require the participant to grant Barbara Anne Photography unrestricted permission to use all portraits publicly.

Participants will be provided with a separate Image Use Agreement allowing them to communicate their preferences regarding the use and sharing of their portraits.

Options may include full image use permission, limited or selected image use permission, or no general promotional image use.

However, because The Woman Within is an exhibition-based portrait campaign, participants understand that the portrait selected for the exhibition and associated campaign publication is intended for public display as part of the project.

Any additional use of portraits by Barbara Anne Photography will be governed by the participant's completed Image Use Agreement and any specific campaign permissions agreed to between the participant and Barbara Anne Photography.

10. Personal Stories & Written Content

Participants may be invited to share personal stories, reflections, quotes, or written responses as part of The Woman Within.

Barbara Anne Photography may edit submitted written material for length, grammar, clarity, and publication formatting while making reasonable efforts to preserve the participant's intended meaning and voice.

Sensitive personal information will not knowingly be added to a participant's story without their permission.

11.Rescheduling

Because professional hair and makeup artists, studio time, and other resources may be reserved specifically for each participant, session dates should be selected carefully.

In the event of an emergency or exceptional circumstance, Barbara Anne Photography will make reasonable efforts to accommodate one rescheduling without a rescheduling fee, subject to availability.

A second rescheduling will incur a $200 rescheduling fee before a new session date can be confirmed.

Repeated rescheduling, failure to attend, or inability to complete the session within the campaign timeframe may result in forfeiture of participation.

12. Cancellation & Non-Attendance

The $495 booking retainer is non-refundable.

If a participant chooses to cancel their participation, fails to attend their scheduled session, or otherwise chooses not to complete the campaign experience, amounts already paid will not be refunded.

Any exception made by Barbara Anne Photography is entirely at the studio's discretion and does not create an obligation to make similar exceptions in the future.

13. Late Arrival

Participants are expected to arrive at the agreed time.

Late arrival may reduce the amount of time available for hair and makeup, photography, wardrobe changes, or other portions of the experience.

Where possible, Barbara Anne Photography will make reasonable efforts to complete the planned experience, but additional time cannot be guaranteed.

Significant lateness may require the session to be rescheduled and may be treated as a rescheduling or missed appointment.

14. Hair, Makeup & Third-Party Providers

Professional hair and makeup services are provided by independent professionals selected or approved by Barbara Anne Photography.

Participants are responsible for informing Barbara Anne Photography and/or the service provider of any known allergies, sensitivities, skin conditions, or other relevant concerns before services begin.

Barbara Anne Photography cannot guarantee compatibility with individual cosmetic, skincare, or hair products.

15. Participant Responsibility

Participants are responsible for communicating any physical limitations, accessibility requirements, wardrobe concerns, personal boundaries, or other circumstances that may affect the portrait experience.

Participants are always encouraged to communicate if a pose, wardrobe choice, styling direction, or other aspect of the session makes them uncomfortable.

Barbara Anne Photography may modify or discontinue any pose, set, wardrobe choice, prop, or activity where there is a reasonable concern regarding safety, comfort, or suitability.

16. Exhibition Date, Venue & Format

The Woman Within campaign is currently intended to culminate in an exhibition following the campaign portrait period.

Exhibition dates, venues, presentation formats, magazine publication dates, and related event details may change due to venue availability, scheduling requirements, participation levels, circumstances beyond the photographer's control, or other operational considerations.

Barbara Anne Photography will make reasonable efforts to communicate material changes to participants.

A change to an exhibition date, venue, format, or publication timeline does not constitute cancellation of the participant's portrait experience and does not entitle the participant to a refund.

17. Force Majeure

Barbara Anne Photography will not be liable for delays, cancellations, changes, or inability to perform obligations caused by circumstances reasonably beyond its control, including but not limited to illness, injury, severe weather, natural disasters, government restrictions, venue closures, equipment failure, transportation disruption, power outages, emergencies, or other unforeseen events.

Where reasonably possible, Barbara Anne Photography will work with affected participants to reschedule or provide an appropriate alternative.

18. Artwork Orders

All artwork orders are considered final once approved and submitted for production.

Because photographic artwork is custom-created specifically for the participant, orders cannot normally be cancelled, returned, exchanged, or refunded once production has begun.

Participants are responsible for reviewing and approving their selections, sizes, finishes, layouts, and other order details before final approval.

Production and delivery timelines are estimates and may vary depending on the product, supplier, shipping, customs, or other circumstances outside Barbara Anne Photography's direct control.

19. Copyright

All photographs created by Barbara Anne Photography remain protected by copyright and are the intellectual property of Barbara Anne Photography unless copyright is specifically transferred in writing.

Purchase or receipt of a digital image does not transfer copyright.

Participants receiving digital files are granted a personal-use licence permitting them to display, share, and print those photographs for personal purposes, subject to any limitations accompanying the purchased artwork or files.

Images may not be commercially reproduced, sold, substantially altered, submitted to competitions, used to promote a business, or provided to third parties for commercial use without written permission from Barbara Anne Photography.

20. Campaign Changes

Barbara Anne Photography reserves the right to make reasonable changes to campaign logistics, scheduling, participating creative professionals, sets, products, exhibition arrangements, publication format, or other operational details when necessary.

Where a material change affects something specifically included in a participant's paid experience, Barbara Anne Photography will make reasonable efforts to provide an equivalent alternative.

21. Limitation of Liability

To the extent permitted by applicable law, Barbara Anne Photography's liability arising from a participant's booking or participation will not exceed the amount actually paid by that participant to Barbara Anne Photography for the applicable service or product giving rise to the claim.

Nothing in these Terms & Conditions is intended to exclude or limit rights or remedies that cannot legally be excluded under applicable consumer protection or other laws.

22. Website Information

Information presented on The Woman Within website, social media, advertisements, emails, and promotional materials is intended to provide an accurate description of the campaign.

In the event of a discrepancy between promotional material and a participant's signed agreement, invoice, booking confirmation, or other individualized written agreement, the individualized written agreement will govern.

23. Governing Law

These Terms & Conditions are governed by the laws of the Province of British Columbia and the applicable laws of Canada.

Any dispute arising from participation in The Woman Within or services provided by Barbara Anne Photography will be subject to the jurisdiction of the courts of British Columbia.

24. Acceptance of Terms

By submitting payment and confirming participation in The Woman Within, the participant acknowledges that they have had an opportunity to review these Terms & Conditions and agrees to be bound by them, together with any applicable booking agreement, artwork purchasing terms, exhibit participation agreement, and Image Use Agreement.

These Photography Service Terms & Conditions ("Agreement") apply to all portrait sessions booked with Barbara Anne Photography ("Barbara Anne Photography", "we", "our", or "us"). By booking a portrait session or paying a booking fee, you acknowledge that you have read, understood and agree to these Terms & Conditions.

1. Booking Your Portrait Experience

Your portrait session is considered confirmed once:

• Any required agreement has been accepted;
• The required booking fee has been received; and
• Your session date has been confirmed by Barbara Anne Photography.

Until all booking requirements have been completed, your requested session date cannot be guaranteed.

2. Booking Fees

Booking fees reserve your session date and cover the planning and preparation involved in creating your portrait experience.

Unless otherwise stated in writing:

• Booking fees are non-refundable.
• Booking fees may be applied toward artwork or portrait collections only where specifically included in your portrait experience.
• Promotional booking fee terms may differ and will be outlined within that specific promotion.

3. Rescheduling

We understand that life happens.

One complimentary reschedule may be granted when reasonable notice is provided.

Additional reschedules may be subject to a rescheduling fee to help offset preparation costs and fees incurred by independent contractors, including professional hair and makeup artists.

Repeated rescheduling may result in cancellation of the session and forfeiture of the booking fee.

4. Cancellations

If you choose to cancel your portrait session, any booking fee paid is non-refundable unless otherwise required by law or specifically stated in writing.

If Barbara Anne Photography must cancel due to unforeseen circumstances, you will be offered the opportunity to reschedule or receive a refund of any booking fee paid.

5. Late Arrivals & No-Shows

Please arrive on time for your portrait session.

Late arrivals may reduce the available photography time while the session still concludes at the originally scheduled time.

Clients who fail to attend their scheduled session without prior notice may forfeit their booking fee.

6. Hair & Makeup Services

Where professional hair and makeup services are included, these services are provided by experienced independent contractors.

Barbara Anne Photography carefully selects these professionals but cannot guarantee their individual services or be held responsible for matters outside our reasonable control.

If a hair and makeup artist becomes unexpectedly unavailable, every reasonable effort will be made to arrange a suitable replacement.

7. Your Portrait Experience

Every portrait session is individually designed based on your consultation, personal style and goals.

While every effort is made to create a diverse gallery, the exact number, poses, backgrounds or images produced cannot be guaranteed.

Photography is an artistic service, and final creative decisions remain at the discretion of Barbara Anne Photography.

8. Image Selection & Ordering

Portraits are viewed and selected during your image reveal appointment whenever possible.

Barbara Anne Photography does not guarantee indefinite archival of unpurchased or delivered digital files.

Unpurchased images may be permanently deleted after a reasonable period without further notice.

9. Artwork & Digital Images

Artwork is custom-produced specifically for each client.

Due to the personalized nature of these products:

• All artwork sales are final.
• Digital image purchases are final.
• Albums, framed artwork, wall art, folios and printed products cannot be returned or exchanged except where required by law.

Minor variations in colour, texture or finish may occur due to printing processes and monitor calibration.

10. Production & Delivery

Production of artwork begins after full payment has been received.

Estimated production times are estimates only and may vary depending on suppliers, shipping delays or seasonal demand.

Barbara Anne Photography is not responsible for delays beyond our reasonable control.

11. Payment

Payment is due according to the invoice provided.

Artwork will not be submitted for production until payment has been received in full unless an approved payment arrangement has been made.

If a payment plan has been agreed upon, all payments must be made according to the agreed schedule.

Barbara Anne Photography reserves the right to withhold delivery of products until all outstanding balances have been paid.

12. Digital Image Licence

Unless otherwise agreed in writing:

Personal portrait digital images are licensed for personal use only.

Business branding portraits include a licence permitting commercial use by the purchasing client for marketing and promotional purposes.

Clients may not:

• resell images;
• transfer ownership;
• submit images into stock photography libraries;
• edit or substantially alter images without written permission.

13. Copyright

Barbara Anne Photography retains copyright of all photographs in accordance with the Canadian Copyright Act.

Purchasing photographs grants a licence for their permitted use but does not transfer copyright ownership.

14. Model Release

Where a separate Model Release has been signed, Barbara Anne Photography may use selected images for portfolio, exhibitions, publications, competitions, advertising and promotional purposes.

Clients who choose not to sign a Model Release will have their privacy respected.

15. Client Responsibilities

Clients are responsible for:

• providing accurate contact information;
• arriving prepared for their session;
• communicating any accessibility or medical considerations relevant to the portrait experience;
• ensuring all minors attending are supervised by a responsible adult.

16. Force Majeure

Barbara Anne Photography shall not be considered in breach of this Agreement where performance is prevented by circumstances beyond reasonable control, including but not limited to illness, severe weather, fire, natural disasters, government restrictions, power outages, transportation disruptions or other unforeseen events.

Where possible, affected sessions will be rescheduled.

17. Limitation of Liability

While every reasonable effort is made to safely create, store and deliver your photographs, liability for any claim relating to photography services shall not exceed the amount paid by the client under this Agreement.

18. Governing Law

This Agreement shall be governed by the laws of the Province of British Columbia and the applicable laws of Canada.

9. Acceptance

Payment of a booking fee, acceptance of an online agreement, electronic signature or participation in a portrait session constitutes acceptance of these Terms & Conditions.

Appendix A - Business Branding & Commercial Image Licence

This appendix applies to Business Portrait, Headshot and Personal Branding sessions unless otherwise agreed in writing.

Commercial Use

Barbara Anne Photography grants the purchasing client a non-exclusive licence to use purchased digital images for their own business marketing and promotional purposes.

Permitted uses include:

• Websites
• Social media platforms
• Printed marketing materials
• Business cards
• Brochures
• Advertising
• Press releases
• Speaking engagements
• Email newsletters
• Professional profiles
• Online directories

Ownership

Barbara Anne Photography retains copyright to all images.

Purchasing digital files grants a licence to use the images but does not transfer copyright ownership.

Employee & Team Use

Images may be used by the business that purchased them and by the individual photographed while employed by that business.

If an employee leaves the organization, Barbara Anne Photography is not responsible for replacing or updating imagery.

Prohibited Uses

Images may not be:

• Sold to third parties
• Licensed to another business
• Used as stock photography
• Entered into AI image training databases
• Altered in a way that changes the artistic integrity of the work without written permission

Minor cropping and resizing for marketing purposes is permitted.

Credit

While not required, crediting Barbara Anne Photography when appropriate is always appreciated.

Image Retouching

Purchased images include Barbara Anne Photography's signature professional retouching.

Additional retouching requests beyond standard editing may be subject to additional fees.

Future Image Updates

Businesses are encouraged to update branding portraits every 1–3 years to ensure marketing materials remain current and reflective of their evolving brand.

Appendix B - Artwork Care, Production & Product Warranty

Barbara Anne Photography proudly partners with professional print laboratories to create heirloom-quality artwork designed to last for generations.

Production

All artwork is custom-made after your order has been approved.

Because every piece is individually produced, production generally begins once payment has been received in full.

Estimated delivery times are provided as a guide and may vary due to supplier schedules, shipping delays or seasonal demand.

Inspection

Clients are encouraged to inspect all artwork upon delivery or pickup.

If your artwork arrives damaged due to manufacturing or shipping, please notify Barbara Anne Photography within seven (7) days so that we can assist in resolving the issue.

Product Warranty

Barbara Anne Photography will work with our professional print partners to address verified manufacturing defects.

This warranty does not cover damage resulting from:

• Improper handling
• Accidental damage
• Moisture or flooding
• Fire
• Excessive heat
• Direct sunlight over extended periods
• Improper hanging or installation
• Normal wear over time

Colour Variation

Every monitor, phone, tablet and printer displays colour differently.

Minor colour variation between digital displays and printed artwork is normal and does not constitute a defect.

Artwork Care

To help preserve your artwork:

• Avoid direct sunlight whenever possible.
• Keep artwork away from excessive humidity.
• Handle prints by their edges.
• Dust framed artwork gently using a soft microfiber cloth.
• Do not use household cleaning products on photographic surfaces.

Albums

Albums should be stored flat when possible and handled with clean, dry hands.

Avoid placing heavy objects on top of albums.

Digital Files

Clients are strongly encouraged to maintain multiple backups of purchased digital images.

Barbara Anne Photography does not guarantee indefinite archival of client files.

Installation

Barbara Anne Photography is not responsible for damage resulting from improper installation of wall artwork.

Professional installation is recommended for larger pieces.

Appendix C - Session-Specific Policies

The following policies apply where relevant to the portrait experience you have booked.

Wardrobe

Clients are encouraged to bring a variety of clothing options discussed during their consultation.

Barbara Anne Photography may provide styling guidance and access to select studio wardrobe items where applicable.

Clients remain responsible for the care of borrowed wardrobe items and may be responsible for repair or replacement costs if items are damaged through misuse.

Children

For family sessions involving young children:

• A parent or legal guardian must remain present at all times.
• Children's cooperation naturally varies, and while every effort is made to create wonderful portraits, specific expressions or poses cannot be guaranteed.
• Session timing may be adjusted to meet the needs of young children.

Pets

Well-behaved pets are welcome during designated pet-friendly sessions.

Clients remain responsible for the supervision and behaviour of their animals at all times and for any damage caused by their pets.

Boudoir & Glamour Sessions

Barbara Anne Photography is committed to creating a respectful, safe and empowering environment.

Clients are encouraged to communicate comfort levels throughout the session.

No pose, wardrobe choice or concept will ever be required.

Clients may request breaks or modifications at any time.

Promotional Portrait Projects

Portrait projects, exhibitions and magazine features may have additional participation requirements, timelines or deliverables.

These will be outlined separately for each project.

Outdoor Sessions

Outdoor sessions are subject to weather conditions.

Barbara Anne Photography reserves the right to reschedule outdoor sessions where weather conditions may compromise safety or image quality.

Creative Direction

Clients choose Barbara Anne Photography because of the studio's artistic vision and creative approach.

While client ideas and inspiration are always welcome, final decisions regarding posing, lighting, composition, editing and artistic interpretation remain the creative responsibility of Barbara Anne Photography.

Image Editing

All delivered images receive Barbara Anne Photography's signature editing style.
